General Terms and Conditions
BWDS Responsibilities
- BWDS shall provide Client with a written estimate.
- In the event work performed will exceed the written estimate by 10% or more, BWDS will provide a reason for the additional costs and afford an opportunity for the Client to modify the terms or cancel the contract.
- BWDS shall inform Client of any 3rd party provided services.
- BWDS will take full responsibility for any Intellectual Property Rights (IPR) violations for BWDS-provided materials.
- BWDS will, upon request, assist Client in the transfer of their website from BWDS control in the event Client desires to engage other service-providers, thus severing the business relationship.
- Upon Cancellation of services, BWDS will provide a refund of unearned deposit funds in accordance with the Refund Policy.
- BWDS will inform Client of any Deliverables necessary to accomplish the desired website work.
Client Responsibilities
- Payment for all 3rd party services is due in advance.
- A deposit of 20% for BWDS provided services is due upon contract origination.
- Balance on Client account will be paid within 14 days of completion of work.
- Payment for maintenance of websites is due within 14 days of invoice date.
- Discounts may apply for advance payments on long-term maintenance agreements.
- The Client understands that work performed by Business Web Design Solutions (BWDS) is dependent on certain deliverables being provided to BWDS.
- BWDS will not be held responsible for Intellectual Property Rights (IPR) violations of materials provided by Client.
- Client is expected to provide written and graphic materials for inclusion on their website, unless BWDS is contracted for such services.
Cancellation Policy
- Client must inform BWDS of their desire for cancellation of services in writing.
- Client-initiated cancellations shall be subject to a 10% penalty of the total estimate amount except for cancellations due to breach of contract.
- BWDS-initiated cancellations shall be provided in the event of inability to fulfill contract due to unforeseen circumstances. BWDS shall provide, without penalty to Client, a full refund of all unearned deposits according to Refund Policy.
- Client shall be responsible to pay for all work completed to date of cancellation notice.
Refund Policy
- Refunds for 3rd party services shall be provided according to the 3rd party provider Terms.
- BWDS will refund all unearned deposits within 14 calendar days, less 10% of total in the event of Client-initiated cancellation as noted in the Cancellation Policy.
- Refunds will be delivered via Registered Mail/Return Receipt Requested.
